These Terms of Service ("Terms") govern access to and use of CollabMarket — the website, mobile-responsive web app, and related services (together, the "Platform") that connect brands with creators for influencer marketing collaborations. By creating an account, browsing creator profiles, publishing a campaign, or otherwise using the Platform, you ("you", the "User") agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Who can use CollabMarket
You must be at least 18 years old and able to form a binding contract in your jurisdiction to register. You are responsible for the accuracy of the information you provide (including your niche, location, social accounts, and company details) and for keeping it up to date. You are responsible for all activity that occurs under your account and for keeping your login credentials confidential.
2. Account types & roles
The Platform supports three user types, each with a distinct role:
- Brands — discover creators, publish campaigns, negotiate and purchase packages, and pay through escrow.
- Creators (Influencers) — build a public profile, list paid packages, apply to or accept campaign invitations, deliver content, and receive payouts.
- Agencies — manage one or more brand accounts on behalf of clients.
CollabMarket is a marketplace that connects brands and creators. We are not a party to, and do not guarantee the outcome of, any collaboration, deliverable, or agreement between a brand and a creator beyond the escrow and dispute mechanics described below. We are not the employer, agent, or representative of any creator, and creators are not employees, partners, or agents of CollabMarket.
3. Discovery, campaigns & packages
Creators may list fixed-price packages (by platform and content type) and/or apply to open brand campaigns. Brands may search and filter creators by niche, location, platform, follower size, engagement, and other criteria that creators choose to make public on their profile — including any preferred work locations a creator lists. Search rankings and AI-assisted match suggestions are provided for convenience; they do not guarantee results, bookings, or performance.
4. Escrow payments, fees & commission
When a brand books a package or accepts a campaign deliverable, the agreed amount is charged up front and held in escrow by our payment processor until the creator delivers and the brand approves the content (or a dispute is resolved). CollabMarket charges a platform commission, deducted from the creator's payout, on each completed order — the current rate is shown at checkout and on the creator's earnings dashboard before you confirm. Payment processing (including card/UPI/bank handling) is performed by third-party payment gateways; we do not store full card or bank account numbers on our servers.
5. Payouts, cancellations & refunds
Creators may request a payout of their available escrow balance to a connected payout method; payouts are processed after admin review. If a brand cancels an order before work begins, or a creator fails to deliver, the affected party may raise a dispute (see below) — outcomes may include a full or partial refund to the brand, a full or partial release to the creator, or another resolution at our reasonable discretion based on the evidence provided.
6. Disputes
Either party may open a dispute on an order if deliverables, timelines, or payment do not match what was agreed. Our team reviews the order history, messages, and submitted content to reach a resolution. Filing fraudulent or bad-faith disputes is a violation of these Terms.
7. Content, ownership & license
You retain ownership of the content you upload to your portfolio or submit as a campaign deliverable. By uploading or submitting content, you grant CollabMarket a non-exclusive, worldwide, royalty-free license to host, display, and reproduce it on the Platform (for example, on your public creator profile, in search results, or in Platform marketing) for as long as your account is active or the content otherwise remains publicly listed. Deliverable usage rights between a brand and a creator (e.g. whitelisting, paid boosting, or repurposing sponsored content) are a matter for the brand and creator to agree directly and are not granted by CollabMarketunless explicitly stated in a package or campaign brief.
You must have the rights to everything you upload. Do not upload content that infringes someone else's copyright, trademark, publicity, or privacy rights.
8. Portfolio & upload limits
To keep the Platform fast and fair for everyone, creators may directly upload a limited number of self-hosted photos and videos to their portfolio (limits are shown in the portfolio editor and may change from time to time); linking to existing posts on YouTube, TikTok, Instagram, or Facebook is unlimited.
9. Social account connections
Creators may connect Instagram and other social accounts to verify their handle, follower count, and (where the platform's API and your account permissions allow) audience demographics. You authorize CollabMarket to retrieve this data from the relevant platform on your behalf via OAuth. You may disconnect a social account at any time from Settings, which stops future syncing but does not retroactively remove data already shown to brands who viewed your profile.
10. Verification & trust signals
CollabMarket may display trust scores, authenticity scores, verification badges, or other signals based on account activity, follower/engagement data, and platform history. These are provided as a convenience to help brands and creators evaluate one another and are not a guarantee of any individual's reliability, content quality, or audience authenticity.
11. Acceptable use
- No fraudulent engagement, fake or purchased followers, or misrepresented metrics
- No circumventing platform payments or fees (e.g. arranging to be paid off-platform for a deal made through CollabMarket)
- No sharing personal contact details (email, phone, external messaging handles) to move a conversation off-platform before an order is placed
- No harassment, hate speech, illegal content, or intellectual-property infringement
- No impersonation of another person, brand, or business
- No scraping, reverse-engineering, or automated bulk data collection from the Platform
- No attempting to circumvent security, moderation, or fraud-detection systems
We use automated moderation to flag suspicious messages and listings (for example, attempts to share payment details or move a deal off-platform). Flagged content may be reviewed, warned, or removed by our team.
12. Reviews
Reviews must reflect a genuine completed collaboration. Do not post fake reviews, pay for reviews, or offer incentives in exchange for a positive review. We may remove reviews that violate this policy or applicable law.
13. Third-party services
The Platform relies on third-party services to operate — including payment processing, cloud media storage, AI-assisted matching, transactional email, and social-platform APIs. Your use of features backed by these services is also subject to the relevant third party's own terms (e.g. Instagram's platform policies apply when you connect an Instagram account).
14. Intellectual property
The CollabMarket name, logo, website, and underlying software are owned by us or our licensors and protected by intellectual-property law. Nothing in these Terms grants you rights to our trademarks or branding beyond what's needed to use the Platform as intended.
15. Disclaimers
The Platform is provided "as is" and "as available". We do not guarantee that any campaign, package, or collaboration will meet your expectations, that the Platform will be uninterrupted or error-free, or that any creator's stated metrics are fully accurate — we take reasonable steps to detect fraud, but cannot verify every claim independently.
16. Limitation of liability
To the maximum extent permitted by law, CollabMarket and its officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to the greater of the platform fees you paid in the six months before the claim, or a nominal amount where no fees were paid.
17. Indemnification
You agree to indemnify and hold CollabMarket harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your collaboration with another user of the Platform.
18. Suspension & termination
We may suspend or terminate accounts that violate these Terms, pose a fraud or security risk, or for other reasonable cause, with or without notice depending on severity. You may close your account at any time from Settings. Orders already in escrow at the time of closure will be resolved according to their status (delivered, disputed, or refundable).
19. Governing law & disputes with us
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a mandatory local consumer-protection law in your country of residence provides otherwise. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts at our place of business.
20. Changes to these Terms
We may update these Terms from time to time to reflect new features, legal requirements, or operational changes. We'll update the "Last updated" date above; material changes will be flagged in-app. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
